Consent to Telehealth

YOU ACKNOWLEDGE THAT BY ACCESSING THIS WEBSITE, ITS ASSOCIATED APPLICATIONS, PLATFORM, AND/OR SERVICES, THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY AND COMPLY WITH THE TERMS SET FORTH HEREIN. IF YOU DO NOT OR CANNOT AGREE WITH ANY PART OF THIS CONSENT TO TELEHEALTH, YOU MAY NOT ACCESS NOR USE THE WEBSITE, APPLICATIONS, PLATFORM AND/OR SERVICES.

Introduction

Remedy Well Inc. (collectively, "we," "our," "us," or "Remedy Well") is an integrative digital health Remedy Well that offers a website and a related application through which users, clients, or other visitors (collectively "you" or "your") may request and obtain online consultations with affiliated independent, licensed Health Care Providers such as nurse practitioners, doctors, mental health counselors, social workers, dietitians, among other Provider types (collectively, a “Provider” or “Providers”) managed by Remedy Well, our associated Management Services Organization (“MSO”) and Medical Professional Corporation (“Medical Group”) and receive consultations, treatment plans, at-home lab kit reviews, diagnoses, or prescriptions through nationwide local and/or mail order pharmacies that Remedy Well has partnered with for the provision of such services (collectively, “Services”). These Services are offered online via telehealth, a method of delivering remote access to healthcare that makes use of a number of telecommunications technologies, including synchronous video or voice, asynchronous chat, text, email, or other secure communication methods remotely. As a result, telehealth may involve the electronic transmission of personal health information such as health records, laboratory findings, necessary photographs, video recordings, information obtained from remote monitoring devices, or similar data for proper clinical assessment, diagnosis, treatment, and follow-up services. Telehealth is additionally used to provide clinical consultations, assessments, diagnoses, health education, treatment, and follow up. Notably, Remedy Well also provides certain auxiliary health coaching services. Please refer to Exhibit A, which is equally covered by this agreement.

Potential Benefits of Telehealth

The potential benefits of telehealth Services include: having access to medical care and health education without needing to leave home, thereby improving access to health care, receiving private diagnosis, and treatment at a time that can be more conducive to client schedules. This can result in improved clinical outcomes and more affordable medical care.

Potential Benefits of Integrative Medicine

While all independent licensed Providers using the Remedy Well platform for the provision of telehealth Services are conventionally trained, licensed, and practice according to the scope of practice outlined by their certifying bodies and states of licensure, Remedy Well does assume a more preventive, integrative approach (collectively “Integrative Medicine”) to its diagnostic and treatment methods. In general, Integrative Medicine may provide benefits that include relief of presenting symptoms and improved function that may lead to prevention, improvement, or elimination of the presenting symptoms, though no particular outcome can be warrantied or guaranteed. Integrative Medicine focuses on nutritional and metabolic imbalances, diet, exercise, environmental influences, and psycho-social factors affecting your health based on the premise that they directly relate to the development and maintenance of illness. Integrative Medicine evaluates these influences and then addresses them using evidence based conventional approaches with a more holistic focus. This encourages clients to give up negative lifestyle patterns that may contribute to negative health outcomes and establish more positive ones, regardless of the type of medical conditions for which they are seeking treatment.

Potential Limitations of Telehealth

Although Remedy Well is dedicated to using industry best practices for the security of our website, application, platform, network, and software, with enhanced security tools and protocols in place to protect personal health information, the electronic transmission of information always involves a certain degree of risk. This includes, but is not limited to, treatment information being disrupted or distorted by technical failures, sessions being interrupted or accessed by unauthorized persons, miscommunication between myself and the provider via Telehealth, being overheard by persons near me, and electronic communication can be forwarded, intercepted, or changed without my knowledge and despite taking reasonable measures. Regulatory requirements in your state may prevent you from obtaining certain Services or prescriptions, your past medical history or a specific presenting condition may prevent you from using telehealth, we may not be able to perform certain tests, and the information you transmit via telehealth may not be sufficient for an accurate diagnosis and treatment. These limitations can prevent proper diagnosis and treatment, and such technology failures may even disrupt Services.

Potential Limitations of Integrative Medicine

Although Remedy Well is committed to employing best practices in the provision of Services, telehealth health Services and the practice of Integrative Medicine are not without certain risks. Potential risks of care and prescribed treatments include, but are not limited to, allergic reactions, sensitivities, adverse effects from, or in response to, prescription medications, supplements or dietary measures, failure to improve or worsening of your condition, and difficulty adjusting to lifestyle modifications as recommended.  

Other side effects and risks may occur. It is your responsibility to inform your Provider of all known factors that might affect treatment, including, but not limited to, all medications, drugs, drug sensitivities and allergies, history of seizures, fits or fainting, presence of a pacemaker, bleeding disorder, active cancer, use of anticoagulants, damaged heart valves or occluded vessels, immune deficiencies, psychiatric mental health conditions, other special risks, as well as any other significant factors within your knowledge.  It is also your duty to inform your Remedy Well Provider of any disorder or state of mind that might affect your capacity to make informed health decisions, and should any such impairment exist, of any surrogate decision maker that may serve on your behalf.

With regard to the practice of Integrative Medicine some of the potential “limitations” or “risks” that have been asserted by some critics include, but are not limited to:

a. Lack of sufficient testing to constitute “evidence-based” medicine;
b. Use of biologically active agents that can present risks when used in conjunction with conventional medical therapies;
c. Delay in seeking mainstream treatment based on scientifically unsupported practices; and
d. Use of laboratory tests, the value of which other practitioners’ questionDespite this debate, Remedy Well's independent Providers only use therapies they consider to be secure and efficient (based on their education, knowledge, experience, and evidence-based investigation). Before they are given, Providers will also let you know the advantages and disadvantages of any suggested treatments, including those of conventional therapies before they are prescribed.

Off-Label Use of Devices or Medications

On the Remedy Well platform, Providers occasionally may suggest FDA-approved medical tools or drugs for conditions in ways beyond those that the FDA has approved.  This practice is referred to as "off-label use."  If a Provider decides that using an FDA-approved product or medication off-label in conjunction with your treatment is clinically appropriate, they will let you know and give you the chance to accept or reject such treatment plans before a prescription is written.

Responsibility to Maintain Separate Primary Care Provider

You are encouraged to speak with and take into consideration the counsel of other Providers, including conventional physicians and Providers, as alternatives to the Providers on the Remedy Well platform. Providers will confer with, but not replace care presently provided by other physicians or Providers, including internists, gynecologists, cardiologists, therapists, psychiatrists, gastroenterologists, or other specialized care Providers. It should be noted that as a requirement for care at Remedy Well, you must maintain a relationship with an outside physician who will serve as your primary care practitioner. You must call 911 or go to a hospital if you are experiencing a medical emergency and are unable to receive treatment from your health care physician.

Products and Responsibilities

Remedy Well may offer certain dietary supplements, at-home lab kits, among other products available for customers on its website in addition to the Services provided by Providers working on the Remedy Well platform. You are free to buy dietary supplements and other products from any supplier of your choice; you are not obligated to purchase products on our website.

No Guarantee of Results

By using Remedy Well products and services, you acknowledge that there is no guarantee that you will experience positive results. It is in your best interest to discuss alternative treatment options with your primary care physician or another qualified specialist before and during treatment, especially if you are being treated for any suspected or actual medical condition The Services provided by Remedy Well do not prevent you from using other treatments or services, although you must notify any practitioners sought of the specific treatments or services that you are receiving from Remedy Well. Failure to follow treatment recommendations and guidelines will affect treatment outcomes. You must inform Remedy Well Providers immediately of any adverse effects of treatment, including any negative or unexpected physical, mental, or emotional effects associated with the use of any Remedy Well products or Services.

Notification of Information that May Affect Eligibility

By using Remedy Well's products and Services, you agree to promptly notify our Providers of any changes that may affect your eligibility for our Services, including pregnancy, breastfeeding or any other treatment that may conflict with receiving treatment from Remedy Well. You are also responsible for disclosing to Providers all medications, lab tests, and assessments received elsewhere to ensure that care is coordinated and appropriate. In addition, it is your responsibility to notify any other healthcare professional of any treatments, supplements, or laboratory tests that you receive from a Remedy Well Provider.

Referrals

Some conditions cannot be treated on Remedy Well via telehealth. By using Remedy Well's Services, you understand that one of our Providers may recommend that you see a medical professional in person. This means you may need to seek treatment in your local community or from your primary care physician.  

Insurance Use and Financial Responsibility

Although Remedy Well may collect insurance information for future application or to assist with navigation of insurance related inquiries for prescription coverage, Remedy Well does not accept insurance and therefore you are financially responsible for the services rendered. Upon request, Remedy Well may provide you with a receipt for Services, but you may not receive full reimbursement or any reimbursement at all. Furthermore, Remedy Well has opted out of and therefore does not participate with nor accept Medicare. Therefore, in your relationship with Remedy Well, if you become an eligible Medicare beneficiary, it is your responsibility to notify Remedy Well so that we can facilitate your transition to the service where these benefits can be used.

Telehealth Acknowledgement

By accepting this Consent to Telehealth, you understand and acknowledge the following: I understand that I have been given informed consent to receive medical care and treatment via telehealth from Remedy Well affiliated Providers. I have read this Consent to Telehealth carefully and understand that using telehealth may provide me with substantial benefits, but as with any medical service offered, results cannot be assured, and there are potential risks that may be involved in the use of telehealth Services. I understand that all existing confidentiality protections under federal and state law apply to information used or disclosed during my telehealth consultation. However, there are both mandatory and permissive exceptions to confidentiality that may allow or require disclosure of information used or disclosed during the telehealth consultation. I understand that Providers on Remedy Well may employ Integrative Medicine approaches in my care, for which I have a right to decline. I understand that Providers on the Remedy Well platform may at times recommend FDA-approved devices or medications to treat a condition in a way that differs from the use specifically approved by the FDA for such device or medication. I have the right to refuse such devices or medications. I understand that affiliated Providers on Remedy Well are an addition to, and not a replacement for, my local primary care provider. I understand that there can be no guarantee of satisfactory results in connection with Remedy Well or other healthcare Services. I understand that my Provider may determine that my condition is not appropriate for telehealth Services and that I may be asked to seek care within my local community or with my primary care provider. I understand that as a condition of service, I must maintain a relationship with an existing primary care provider as Remedy Well cannot replace such a relationship.

I UNDERSTAND THAT I CANNOT OBTAIN URGENT OR EMERGENT CARE THROUGH REMEDY WELL AND AS SUCH, IF I AM EXPERIENCING A MEDICAL EMERGENCY, I MUST SEEK CARE AT MY LOCAL EMERGENCY DEPARTMENT OR CALL 911.  

I understand that I will have access to all of my health care information at my request and in accordance with applicable laws and regulations. I furthermore agree and authorize Remedy Well and Providers to collect, use, and share my information, including my personal health information for any purposes permitted by law, including for treatment, payment, and health care operations. I understand that Remedy Well employs certified health and wellness coaches to facilitate the client experience and that I am not required to participate in these auxiliary services. Please see Exhibit A for consent to Remedy Well health coaching services. I understand that I have a responsibility to answer all questions about my health including my medical history honestly, and accurately as withholding such information could result in harm to me including in some cases, death. As such, I will keep my Provider informed of any changes in my health status, diagnoses, symptoms, treatments, medications, and/or supplements used. I consent to hold harmless Remedy Well including the associated MSO and Medical Group including their Providers, partners, vendors, pharmacies, Parent Company, agents, and subsidiaries in the event that my information is compromised; breached; lost; stolen; or my care is otherwise delayed as a result of the compromise or failure of Remedy Well’s website, applications, or platform technology. I understand that I can withdraw consent and cancel at any time in writing by emailing . Otherwise, this consent will be considered renewed upon each new telehealth consultation.

EXHIBIT A

INFORMED CONSENT FOR HEALTH COACHING

By using Remedy Well’s website, application, and platform to receive Services as described in this agreement, including auxiliary services defined within Exhibit A, I acknowledge that I have read and understood the risks and benefits associated. I understand that I am a willing participant, and I am free to accept or decline Services described herein as offered by Remedy Well employed Health Coaches, skin care coaches, or mind care coaches ( collectively, “Health Coaches”).

RISKS
As with any supportive service, health coaching is not without associated risks. Potential risks include, but are not limited to: allergic reactions, sensitivities, side effects, adverse effects from, or in response to, natural supplements or dietary measures, negative reaction or interactions with prescription or over-the-counter drugs, bodily injury, illness, failure to improve or worsening of my condition. Furthermore, care often involves discussing unpleasant aspects of life, meaning you may experience uncomfortable feelings like sadness, guilt, regret, or anger. Although our coaches are trained to provide excellent supportive care, we make no guarantee regarding what emotions may be elicited through health coaching. Other side effects and risks may occur.

BENEFITS
Health coaching may provide certain benefits that include relief of presenting symptoms, improved sleep, improved physical function, improved habits, feelings of support and general accountability. Experiences and results may vary, therefore no particular outcome shall be warrantied or guaranteed.  

ALTERNATIVES
You are under no obligation to engage in health coaching with us, and you have the right to seek alternatives including to all together refuse health coaching without seeking alternatives.

HEALTH COACHING SERVICES WAIVER
By participating in health coaching through Remedy Well, you are seeking to engage with our Health Coaches of your own free will. You understand that health coaching should NOT be viewed as a substitute or replacement for consulting with a licensed physician, nurse practitioner, registered nurse, dietitian, counselor, therapist, or other health professional. Occasionally, Remedy Well affiliated Providers may be additionally certified as Health Coaches. As such, these Providers have been instructed to indicate their capacity of service at the time of service to remove any confusion over scope of engagement. By using this service, you acknowledge that you are aware of such potential and can freely ask questions or decline Services before or during health coaching sessions.

ACKNOWLEDGEMENT
In consideration of the opportunity to participate in health coaching with Remedy Well, I understand that no promises have been expressed or implied regarding the use of health coaching and hereby irrevocably waive, release, indemnify and hold harmless Remedy Well, including the associated MSO, Medical Group, Providers, partners, vendors, pharmacies, Parent Company, agents, and subsidiaries from all manner of action or actions, suits, claims, or demands resulting from my willful participation in health coaching online, or in the event that my information is compromised; breached; lost; stolen; or my care is otherwise delayed as a result of the compromise or failure of Remedy Well’s website, applications, or platform technology . I agree that I have a standing opportunity to ask questions and affirm that I understand that health coaching is not a substitute or replacement for consulting with a licensed physician, nurse practitioner, registered nurse, dietitian, counselor, therapist, or other health professional. I understand that I can withdraw consent or cancel at any time in writing by emailing support@remedywellhealth.com. Otherwise, this consent will be considered renewed upon each new telehealth consultation.

USE AGREEMENT

By establishing an account and/or logging into Remedy Well’s website, applications, and/or platform, and by otherwise using any of Remedy Well Services, you are automatically acknowledging and accepting the current version of this Consent to Telehealth. Any changes will be updated and made available on our website, superseding, and replacing all prior versions.
